Will of Mathew Lindley of Cawthorne(proved June 7, 1661) In the name of God Amen, the tenth day of February in the yeare of our Lord god one thousand sixe hundred fifty sixe I Mathew Lindley of Cawthorne in the County of Yorke yeoman being infirme in body, but a good remembrance (praised the god) do make this my last will and testament in manner and forme following. First, I commit and comend my soule into the handes of God who gave it and my body to the earth to be buried where God shall please to call me and my children and friends thinke fitt being assured of the Resurrection thereof at the last and great day by the virtue and power of Christ my head and Saviour having good hope through his grace that it shall be then consigned to my soule and made partaker of that heavenly inheritance reserved for the Saints in the highest. And as touching my worldly estate in landes and goodes I dispose thereof, as followeth. First my will and minde is that my funerall charges and all my debts I owe or which in conscience and equity I ought to pay be paid and discharged forth of my wholl estate in lands and goods. And whereas I have allready paid and to my eldest sonne Thomas Lindley at his request and to his use (and am engaged to pay for him more then) theree hundred poundes so that he hath sealed me a release whereby it may appeare he thearby acquitte all his right interest clayme or title to any further childes part or portion out of any parte of my estate, Now will and minde is and I do hereby give and bequeath unto my said sonne twenty shillings in full discharge of his childes part and portion. And unto Joshuah Lindley my youngest son allso I give twenty nobles. And unto Martha lindley, my daughter one hundreth pounds to be paid within one yeare next after my decease. And as touchinge all other estate in landes and goodes my will and minde is and I do hereby give bequeath and graunte unto Mathew Lindley my second sonne All my messuages, tenements, ediffices, buildings, houses, fouldes, orchards, gardens, tofts, crofts, closes, meadowes, pastures, arrable groundes, profitts, emoluments, tithes of corne and grain, hay, wooll and lambs and all other Tithes whatsoever, as well great as small, whereof I now stand seized and possessed in fee simple or fee taile whether now in my tenure or in the occupation, or in the occupation of my Assignes for undertenants, wherein lying within the townshipp of Cawthorne and County of Yorke aforesaid. And the reversion and reversion remainder and remainders of all the said premisses with all and every their Appurtenances to have and to hould the said messuages, tenements, ediffices, buildings, houses, fouldes, orchards, gardens, toftes, crofts, closes, meadows, pastures, arrable, groundes, profitts, emoluments, hereditaments, tithes of all kindes, all and singular other the premisses with the appurtenances whatsoever abovesaid unto him the said Mathew Lindley the younger his heires and assignes for ever. To the only use and behoofe of the said Mathew Lindley his heires and assignes for ever unto whom allso I do hereby give and bequeath all my household goods and stuff (not formerly disposed of) and all my other worldly goodes, billes, bondes, debtes and personall estate, whatsoever. And I do hereby make the said Mathew Lindley sole executor of this my last will and testament. And I desire and hereby make Thomas Passley and John Shirt my neighbors and trusty friendes supervisors hereof to see that this my will be executed done and performed as is above specified and declared in these presents these being the severall uses whereunto a deed of feoffment by me sealed and delivered and peaceable possession and seazin of and in parte of the landes and premises in the name of the whole was given unto the said Thomas Passley relates as by the said deed bearing date the fourth day of October in the yeare of our Lord god one thousand sixe hundred and fifty sixe more at large doth and may appeare. In wittnes whereof to this my last will and testament written with my own hand and sealed with my own seale I have subscribed my name the day and yeare above written.

Crossed out part reads: this will was proved at London the 17th day of July 1660 before the judges for probate of wills they granting adm[inistrati]on by the oath of Mathew Lindley the sonne sole executor etc To whome adm[inistrati]on etc was comitted, he being first by commission sworne truly to administer. On accompanying sheet: This will was proved at London the 19th day of July 1660 before the Right Wor[shipful] William Mericke Dr of Lawes, Keeper or Comissary of the Prerogative Court of Canterbury lawfully constituted by the oath of Mathew Lindley the sonne sole executor etc To whome Adm[inistrati]on etc was comitted he being first by Comission sworne truely to Administer etc. The index gives date of probate as June 7 1661.
